2. General information on data processing

We only process personal data insofar as this is necessary to provide the website, process orders, handle requests or run our offers. Personal data is any information relating to an identified or identifiable natural person.

3. Hosting and the Shopify shop system

4. Orders in the online shop

When you place an order, we process in particular your name, billing and delivery address, email address, payment information and order data. The legal basis is Art. 6(1)(b) GDPR.

5. Email communication and team requests via IONOS

Email communication and team requests are currently handled via email services provided by IONOS. Automatic emails from our website (e.g. confirmations of receipt for Team Funding) are also sent via the servers of IONOS SE.

If you contact us by email or submit a Team Funding request, we may process in particular your name, contact details, email address, phone number, club data, the content of your message and technical transmission and log data. The legal bases are Art. 6(1)(b) and Art. 6(1)(f) GDPR. We have concluded a data processing agreement with IONOS SE pursuant to Art. 28 GDPR.

Contact form
If you use our contact form, your email address, the selected enquiry topic and your message are transmitted by email to our service mailbox. They are not stored in a database. We use your email address solely to respond to your enquiry. The legal basis is Art. 6(1)(b) GDPR (handling your enquiry) or Art. 6(1)(f) GDPR (legitimate interest in responding to contact enquiries). We delete the correspondence as soon as your request has been dealt with conclusively and no statutory retention obligations apply.

6. Team Funding and club requests

Application via the Team Funding form
When you submit the application form, the following happens: your details (club name, contact person, email address, phone number, number of athletes, website or social media profile and your message) are transmitted by email to our funding mailbox and additionally stored in a database on servers of our hosting provider IONOS SE (Montabaur, Germany). You automatically receive a confirmation of receipt by email. The legal basis is Art. 6(1)(b) GDPR (assessment and performance of participation in the programme). We delete unsuccessful applications no later than six months after the assessment has been completed, unless statutory retention obligations apply.

Handling of the sponsoring credit
If your club takes part in the programme, its members receive a team code for our shop. When an order is placed with this code, our Shopify shop system automatically reports the order to our server at IONOS. Only the following is transmitted and stored: order number, order status, order value, currency and the team code used. Names, addresses or payment data of the people ordering are neither transmitted nor stored. From this data we calculate the sponsoring credit and document every credit entry as well as corrections for refunds or cancellations in a traceable manner. Attribution is made solely to the club via the team code; the club likewise receives no data on individual customers. The legal bases are Art. 6(1)(b) GDPR (performance of the programme) and Art. 6(1)(f) GDPR (legitimate interest in traceable, abuse-proof accounting). We store the accounting data for the duration of participation and within the statutory commercial and tax retention periods (Section 147 AO, Section 257 HGB).

Secure club area (login)
With the approval email, participating clubs receive login details for a personal, password-protected funding area. There we process: the username, the password exclusively as an irreversible hash value (never in plain text), the time it was last issued, and the fundraising goal chosen by the club itself. To keep you signed in we set a technically necessary session cookie that ends when you close your browser or log out. To prevent automated login attempts, we count failed logins per hour using an irreversible hash value of the IP address; the IP address itself is not stored in plain text. The legal bases are Art. 6(1)(b) GDPR (performance of the programme) and Art. 6(1)(f) GDPR (legitimate interest in the security of access). We delete the login details when participation ends.

Payouts
If a club requests a payout in the funding area, we store the requested amount, the current balance and the time of the request, and notify ourselves by email. Everything else is handled personally with the club. The legal basis is Art. 6(1)(b) GDPR.

Team stories (voluntary testimonials)
Clubs can voluntarily submit a testimonial in the funding area. We process: the star rating, the text of the testimonial, the name and role of the person named, the town, the club name and optionally a team photo and a club logo. This information is intended for publication on our Team Funding page. Every testimonial is reviewed by us manually before publication and is only shown once approved. When submitting, the club confirms that the necessary consent of everyone shown and named has been obtained; for minors, the consent of their legal guardians. The legal basis is Art. 6(1)(a) GDPR (consent). Consent can be withdrawn at any time with effect for the future; we will then remove the testimonial and the associated images from the website without delay. Please contact us using the details given in the legal notice. The content is stored on servers of our hosting provider IONOS SE (Montabaur, Germany) until consent is withdrawn or the purpose ceases to apply.

7. Product reviews

Submitting a review
You may voluntarily submit a review on our product pages. In doing so we process: the star rating you assign, your review text, the display name you choose, your email address and the time of submission. In addition, to prevent abuse (spam, multiple submissions) we store an irreversible check value (hash) of your IP address; the IP address itself is not stored in plain text. Only the display name, star rating, review text and date are published. Your email address is not published and is used solely for any questions about your review and for abuse prevention.

Review before publication
Every review is checked manually by us before publication and is only shown after approval. We reserve the right not to publish reviews with unlawful, offensive or obviously untrue content.

Storage and legal basis
Reviews are transmitted by email to our service mailbox and stored in a database on servers of our hosting provider IONOS SE (Montabaur, Germany). No review or third-party service is used; processing takes place exclusively on our own infrastructure. The legal basis is Art. 6(1)(a) GDPR (your consent to publication given upon submission) as well as Art. 6(1)(f) GDPR (legitimate interest in authentic, abuse-proof product reviews). You may withdraw your consent at any time with effect for the future and request deletion of your review; to do so, please use the contact details stated in the legal notice. We store reviews until you request their deletion or the purpose ceases to apply.

8. Payment providers

Depending on the payment method chosen, we pass payment data to the relevant payment service provider. In particular this may include credit card, PayPal, Apple Pay, Google Pay and Shopify Payments, provided these payment methods are active at checkout. The data is passed on for payment processing on the basis of Art. 6(1)(b) GDPR.

9. Shipping service providers

To deliver your order, we transmit your name, delivery address and, where applicable, email address for shipping notifications to the relevant carrier. Processing takes place in order to fulfil the purchase contract.

10. Cookies, local storage and tracking

This website does not use any tracking, analytics or marketing cookies, nor any such services. When our pages are accessed, no connections are made to advertising or analytics providers. A cookie banner is therefore not required.

Audience measurement without cookies: To understand how often and at what times our pages are viewed, we count page views using our own counter running on our server. No third-party analytics service is used, no cookies are set and no information is accessed on your device; consent under Section 25 TTDSG is therefore not required. We store only the page viewed, the date and hour of the visit, the language version, the type of device (computer, tablet or mobile phone) and, where available, the address of the referring page. Your IP address is not stored. So that several views belonging to one visit can be grouped together, we create a short checksum from the IP address, the browser identifier and a secret random value. This random value changes every day and is deleted after three days; the checksum can then no longer be linked to any person, and visits on different days cannot be connected. The legal basis is Art. 6(1)(f) GDPR; our legitimate interest lies in the statistical analysis of usage and in improving our offering to meet actual needs. The counter data is deleted automatically after twelve months. You may object to this processing at any time under Art. 21 GDPR; please contact us using the details given in the legal notice.

Session cookie in the club area: Only in the password-protected funding area for clubs do we set a technically necessary session cookie after login, which keeps you signed in. It contains no personal content, is not used for analytics and ends when you log out or close your browser. This storage is technically required for the function you requested (Section 25(2)(2) TTDSG) and does not require consent.

Local storage (cart): For the cart function we use your browser's local storage (localStorage). The items you select are stored solely on your device; this data is not transmitted to us or to third parties. This storage is technically necessary for the function you requested (§ 25 (2) no. 2 TTDSG) and does not require consent. You can remove the data at any time via your browser's "clear browsing data" function.

Fonts: All fonts used are stored locally on our server. No connection is made to Google Fonts or other external font services.

Social media links: Links to Instagram, TikTok and Facebook are plain links without embedded platform content. Data processing by the respective platform only begins once you actively click such a link and visit the platform.

Should we use third-party analytics or marketing services in the future, this will only take place after prior consent via a consent banner; this privacy policy will then be updated accordingly.

11. Services and apps used

No third-party services (analytics, marketing, external embeds) are integrated on this website itself. Purchases are completed via the Shopify shop system (checkout); Shopify's privacy notices with their own consent management apply there in addition. Infrastructure used: hosting, database and email dispatch via IONOS SE (see sections 4 to 7).

12. Your rights

Under the GDPR you have the right to information, rectification, erasure, restriction of processing, data portability and the right to object to processing. You may also lodge a complaint with a data protection supervisory authority.

13. Storage period

Personal data is only stored for as long as is necessary for the respective purpose or as required by statutory retention obligations.

3. Offer and conclusion of contract

The presentation of products in the online shop does not constitute a legally binding offer. By clicking the "Order with obligation to pay" button, you submit a binding offer to purchase the goods in your cart. The purchase contract is concluded as soon as we confirm your order by email.

4. Prices and shipping costs

All prices are final prices and include statutory VAT. Shipping costs are clearly displayed during the order process. For deliveries within Germany, standard shipping is €5.90. From an order value of €69 we deliver free of shipping charges within Germany.

5. Delivery

Delivery is made to the delivery address provided by the customer. Delivery times are stated on the respective product page or during the order process.

6. Payment

7. Retention of title

Right of withdrawal

Right of withdrawal

You have the right to withdraw from this contract within fourteen days without giving any reason. The withdrawal period is fourteen days from the day on which you, or a third party named by you who is not the carrier, take(s) possession of the goods.

Exclusion of the right of withdrawal

The right of withdrawal does not apply to sealed goods which are not suitable for return for reasons of health protection or hygiene if their seal has been removed after delivery.

Consequences of withdrawal

If you withdraw from this contract, we shall reimburse all payments received from you, including delivery costs, without undue delay and at the latest within fourteen days from the day on which we receive notification of your withdrawal.

Return of goods

You must return or hand over the goods to CheerNutritions UG (haftungsbeschränkt), Cunistraße 45, 13127 Berlin, Germany, without undue delay and at the latest within fourteen days from the day on which you notify us of your withdrawal. You bear the direct cost of returning the goods.

We currently deliver within Germany and to selected European countries. Delivery is made to the delivery address provided during the order process.

Team Funding Terms

Participation

Cheerleading clubs, teams and organisations are eligible to participate after prior approval by CheerNutritions. There is no entitlement to participation. CheerNutritions may reject requests or deactivate team codes.

Team discount

Members of an approved team receive 10% off eligible orders. CheerNutritions may exclude individual products or promotions.

Sponsoring

In addition, the club receives 10% sponsoring credit on the discounted order value. The calculation is based solely on the order value actually paid.

Exclusions

No sponsoring credit arises in the event of withdrawal, return, cancellation, non-payment or misuse. Amounts already credited may be corrected.

Payment

Payments are made exclusively to the club. Payment to individuals is excluded.

Purpose limitation

The sponsoring is intended exclusively for club purposes, for example training equipment, competitions, club events and youth development.

Club area and login details

On approval, the club receives login details for a personal, password-protected funding area. The login details must be kept confidential and may only be shared within the club. The club informs us if login details are lost.

Testimonials

If a club voluntarily submits a testimonial, it warrants that the necessary consent of everyone shown and named has been obtained, and for minors that of their legal guardians. CheerNutritions reviews every testimonial before publication and removes it again at any time on request.

Data processing

To calculate and document the sponsoring credit, CheerNutritions processes order data (order number, order value, order status and team code used) in accordance with our Privacy Policy. Personal data of the ordering members is not disclosed to the club.

Legal recourse

Recourse to the courts is excluded.
